| | Martha Stewart Nailed By Broker | | Connecticut soccer moms stand weeping up and down I-95 tonight. Turns out that her broker at Merrill Lynch has stated that his assistant did tell the arts and crafts diva that ImClone's CEO was dumping his stock. Tonight's Meal: Prison Pasta |

| | Umm, people in Westport hate her. Her neighbors really hate her.
Trust me.
They're not weeping. They're doing the dance of joy. |

| | But even if she was warned, if she had a stop loss order for $60 that existed prior to the warning, and just did nothing to change it, might she still be innocent?
I don't watch, read, or buy Martha Stewart. I'm just trying to give her the benefit of the doubt. |

| | I guess the question would then turn on, did the stop-loss order take effect, or was the sale initiated before that would have been triggered? |

| | I'm wondering if the stop-loss has to be in writing, or if they will accept a handshake or some sort of verbal recognition.
I think Martha could always say she "thought" she had a stop-loss from the way she "interpreted" certain conversations with her brokers. I think it's going to turn into a kind of "he said, she said" type of thing with Martha making claiming that , in her mind, she made certain "inferences" which "led her to believe" she had some sort of agreement---even if it's absolutely proven there was no such agreement.
She basically, made a mistake, and was under a misinterpretation that was unintentional.......yada yada yada. It will be intersting to see how she gets out of it. I can't see a jury sending Martha Stewart to jail, though. |

| | In the grand scheme of things, this is fairly minor. If it happened to anyone other than Martha Stewart, we'd never hear about it in the news.
I couldn't see jail as even a remote possibility for her, but perhaps community service?
