| | I dunno. McDonald's sued Burger King 15-20 years ago on a similar type of thing (forgot the details) and won. BK had to pull the ads and the child actress in them couldn't eat at McDonald's much like Jared the Subway guy can't eat at other fast food places. This actress: Sara Michelle Gellar, the slayer herself.
But Ive been in businesses where we've had outside counsel write the competitor and suggest they stop advertising a claim or face an action. Can't give 'em an inch, you guys know that. |

I think the athlete taking the 50 calorie drink might win (this would assume similar sizes and fitness levels.) |

The person who consumes more calories (assuming similar rates of burning those calories off) will be heavier and (possibly) slower.
An argument can be made either way.
