DC Judge Sues Drycleaner for $65M Over a Pair of Pants

Owners repeatedly offered to settle, but judge is not deterred.

As part of his suit, the judge is claiming he has to spend $15,000 a year to rent a car every weekend to drive his clothing to another drycleaner.

When Pearson sought to broaden the case to try to prove violations of consumer protection laws on behalf of all District residents, D.C. Superior Court Judge Neal Kravitz said that "the court has significant concerns that the plaintiff is acting in bad faith" because of "the breathtaking magnitude of the expansion he seeks."

At a June 11-12 non-jury trial, Associate Judge Judith Bartnoff will decide if the pants presented as evidence indeed belong to Pearson. Don't ask me why there's a second judge, I'm confused on that part. But here's where she's at:

“At the end of the day, this is a case about one pair of pants that either was or wasn’t fixed and was or wasn’t lost,” Bartnoff said at the March 21 hearing, echoing Kravitz’s initial ruling. “All that’s relevant is, ‘Are these pants yours or not?’”

Pearson maintains that the Chungs failed to alter his pants by May 5, 2005, after he dropped them off May 3. He claims they substituted a different pair of pants that didn’t match his suit jacket.

During the hearing, Bartnoff became increasingly frustrated with Pearson’s interruptions and litany of special requests. For instance, she told him he would be able to call only four witnesses from the list of 50-plus he submitted.

“The witness list is enormously disturbing,” she said, adding that their complaints regarding Custom Cleaners were way beyond the scope of the trial. “This list is so long … it’s so out of proportion to the issue in this case.”

Bartnoff questioned how much emotional distress anybody suffered over one pair of pants and also quizzed Pearson about his request to present video at the trial supposedly showing distances he had to travel to find a dry cleaner now that he no longer used the one in his neighborhood.

“I don’t think you have a fundamental right to have a dry cleaners within four blocks of your house,” Bartnoff said.

I read in an earlier story that the judge had cried when he was testifying about how the dry cleaners had lost his pants. That struck me as very strange, and made me wonder if he might not be obsessive-compulsive. I have a touch of obsessive-compulsiveness myself, and can get quite upset when favorite possessions are ruined or lost. That might explain why he would get so upset when remembering the incident, and also why he embarked on such an aggressive crusade against the dry cleaners in the first place.

It sounds like much more than moderate OCD. He was so fixated on the pants that when he couldn't get a lawyer to take the case, he proceeded anyway. I can't imagine how he got to be a judge with a quirk that big, so I would speculate that this is some problem of more recent onset.

Ask me about all my grandmother's and mother's stuff that was sold at auction, and the emotional wreck I was. Or the necklace that I had then I was 10 that my cousin wore for half an hour and then broke and how I cried when the store clerk gave me a new identical one instead of fixing the other one. Or the stupid things I cry about when they break now, when I'm mumblmemumble years old and really should have more perspective.

Whether or not the guy has mild/moderate/severe OCD, reality intruded and he'd long passed the point where he should have sucked it up or gotten mental help - either way, the legal system was abused by his filing this case. The fact that he himself is a district judge is a very scary thought, especially if he uses the same lack of judgement in deciding the cases that come before him.

He's not a district judge -- he's an administrative law judge, which can be more like a hearing officer than a courtroom judge (and he may not be any kind of judge for much longer). Other than that, I do agree with what you're saying. I just think it's interesting, from a psychology perspective, to think about why someone would cry in a courtroom while testifying about losing a pair of pants.

He lost, big time -- he gets nothing and has to pay court costs for the defendants, who are now talking about suing him for legal fees. It's also looking very much as though he's going to be an ex-judge very soon.

Apparently he is a real nutcase -- he was so vicious during his divorce proceedings that the judge noted in in the verdict.
