I am astonished! File Sharing Ruled Legal in Canada

Quote:

On Wednesday, Mr. Justice Konrad von Finckenstein of the Federal Court of Canada dismissed a request brought by CRIA that some of Canada's largest Internet service providers be forced to turn over confidential customer information, which CRIA believes could help it sue 29 Canadians for copyright infringement.

In what some lawyers privately said was an embarrassing loss for the record industry, Judge von Finckenstein not only denied the request but went further, ruling on a variety of issues involving copyright, on-line privacy and the liability of Internet service providers. Almost nothing in his 31-page ruling could be seen as favourable to the record industry, legal experts said

This is interesting:

First, a study released Monday by business school professors at Harvard University and the University of North Carolina concluded that there was no correlation between on-line downloads and music sales.
But I am not sure the thread title is quite accurate. File sharing wasn't ruled legal per-say.

Well, that's true, Amy...I just copied the headline I saw on the hotmail homepage.

Still, the decision has certainly set up some roadblocks for record companies in Canada.

Re: I am astonished! File Sharing Ruled Legal in Canada

If the Canadian Parliament is anything like our Congress, their representatives might not be so popular if they change the copyright law to side with big business instead of consumers.

I'm in my 50's. I don't download music, although I love music. I do buy some CD's used from half.com or CD Warehouse.

But many people I know who are in their 20's dislike the RIAA almost as much as they do Al Quaeda, and would raise a huge hue and cry if our American Congress ever tried to tighten copyright laws.

It will probably be the same in Canada.

What do you consider "huge?" The DMCA passed. I didn't notice the young adult opposition having much of an effect on that legislation.

lol

Well there's the understatement of the year.

And frazzledspice, if I may ask you, why are you astonished by the court's decision? Do you support the court's decision here?

I guess Canada's a pretty cool place after all. I shall refrain from belittling the country....for now....
